Update: FTC Orders Everalbum to Destroy Illegally Obtained Facial Recognition Algorithms

    On May 6, 2021, the Federal Trade Commission (FTC) approved a Final Consent Order against photograph storage application developer Everalbum, Inc., in which the FTC requires “the destruction of models and algorithms developed in whole or in part from user photos that it scanned and used without permission.”

    This Order comes following a January 2021 settlement between the FTC and Everalbum, in a matter surrounding allegations that the defendant had failed to obtain customer consent for its “Ever” application’s use of facial recognition technology to tag images.
