On January 11, 2021, the Federal Trade Commission (FTC) announced a settlement with Everalbum, Inc., following allegations that the photograph storage application developer had deceived customers regarding its “Ever” application’s use of facial recognition technology to tag images.
The FTC also alleged that Everalbum had deceived its customers regarding the company’s photo retention practices for deactivated users. As part of the settlement, Everalbum must delete “the photos and videos of Ever app users who deactivated their accounts,” and must delete “any facial recognition models or algorithms developed with Ever users’ photos or videos.”
