On February 10, 2021, the U.S. International Trade Commission (ITC) announced a decision in the matter of Certain Lithium Ion Batteries, Battery Cells, Battery Modules, Battery Packs, Components Thereof, and Processes Thereof, in which South Korean company SK Innovation had violated Section 337 of the Tariff Act of 1930: “unfair methods of competition and unfair acts in the importation of articles into the U.S.”
The investigation began in June 2019 when LG Chem, Ltd. alleged that SK Innovation had misappropriated trade secret information related to their electric vehicle batteries by stealing information from former LG employees, scientists, and engineers.
