Trial Court Rules that Employee Did Not Obtain Trade Secrets Through “Improper Means”

    On October 2, 2019, a judge in the Fairfax Circuit Court 19th Judicial Circuit of Virginia held that “merely keeping trade secrets properly obtained during employment upon termination does not violate” the Virginia Uniform Trade Secrets Act (VUTSA).

    The trade secret misappropriation case began when management consulting firm Knowesis, Inc. alleged former employee Bobi Herrera failed to return a company device containing company trade secrets following termination.
