Federal Circuit Rules Object-Oriented Simulation Patent Invalid under Alice Framework

    On December 29, 2020, the U.S. Court of Appeals for the Federal Circuit affirmed a U.S. District Court for the District of Utah opinion in the patent infringement matter of Simio, LLC v. FlexSim Software Products, Inc., in which the Federal Circuit found Simio’s claims were not patent eligible under Alice’s two-step framework.

    The patents in dispute relate to a process of “using graphics instead of programming to create object-oriented simulations,” which the Federal Circuit ruled as abstract.
