European Union Court Rules on the Use of Cookies

    On October 1, 2019, the Court Justice of the European Union (CJEU) issued a judgment stating that “internet users must actively consent” to the use of online tracking cookies within the EU.

    The case was referred to the CJEU by the German Federal Court of Justice and began in 2013, when a German consumer protection organization alleged that online lottery company Planet49’s use of a pre-ticked checkbox to obtain user consent did not comply with European data privacy regulations.
