On December 27, 2020, the U.S. Congress passed the Copyright Alternative in Small-Claims Enforcement (CASE) Act as part of the Consolidated Appropriations Act of 2021.
The CASE Act established a Copyright Claims Board within the U.S. Copyright Office, which provides an alternative forum for copyright owners to 1) pursue civil copyright claims and counterclaims set at a maximum of $30,000 in damages, 2) seek declaratory judgment of non-infringement, and 3) address claims relating to notices filed under the Digital Millennium Copyright Act (DMCA).
