DisputeSoft was engaged as a technical expert in June 2017 on a large-scale software project failure dispute.

    In 2005, the Pennsylvania Department of Labor & Industry had issued a request for proposal (RFP) in search of an IT systems developer that could design and build a new computing system to replace their outdated, legacy system. The developer failed to deliver a comprehensive functioning computing system by the contract deadline, despite being paid more than $150 million.

    Nature of Dispute

    The Department of Labor & Industry filed a lawsuit against the IT systems developer (IBM), alleging that:

    The developer failed to design and construct a functioning system.

    The developer breached their contract by failing to properly manage the project and complete the project on time.

    The DisputeSoft team developed a series of robust expert reports with objective opinions on the quality of the IT systems developer’s application of software engineering and project management best practices, as well as the cause of the project’s ultimate failure. The case settled in August 2021.
