City of West Palm Beach v. VisionAIR, Inc.

    DisputeSoft was engaged as a software expert in March 2007 by the defendant in the matter of City of West Palm Beach v. VisionAIR, Inc., a civil dispute before the U.S. District Court for the Southern District of Florida. The lawsuit related to the development and implementation of an integrated public safety information management system (IMS).

    In December 2000, the City of West Palm Beach (the City) contracted with VisionAIR to implement a public safety IMS which included modules for a 911 call center, Computer Aided Dispatch (CAD) system, Records Management System (RMS) for Law Enforcement and Fire, mobile in-car dispatch and reporting, and geographical mapping.

    Nature of Dispute

    The City placed the CAD, RMS, and Mobile products into production by August 2001. After go-live, VisionAIR provided help desk support until November 2003 following the expiration of warranty service. The City continued to operate its public safety IMS until September 2006, but filed suit in June 2005 alleging that VisionAIR:

    Provided software that did not conform to the features and functions outlined in the contract, and did not materially operate according to the documentation.

    Implemented software that was not properly tested in accordance with industry practice and did not integrate with the City’s other systems and applications.

    Failed to provide qualified individuals to perform maintenance services in a professional and workmanlike manner.

    Conducted a functional review of the CAD, Mobile, Paperless, and RMS products and documentation.

    Analyzed help desk call logs, reported issues, and code defects to reach an opinion as to whether the software performed in accordance with the contract and accepted industry practices.

    Founder Jeff Parmet proffered an expert report on behalf of VisionAIR on May 28, 2007. The City of West Palm and VisionAIR entered into a settlement agreement for an unspecified amount in October 2007, prior to deposition or trial.
