CAFC Reverses $6.3 Million Pre-Suit and Enhanced Damages Award in Patent Infringement Dispute

    On July 14, 2020, the U.S. Court of Appeals for the Federal Circuit (CAFC) reversed a pre-suit damages and enhanced damages award of $6.3 million by the U.S. District Court for the Eastern District of Texas in the matter of Packet Intelligence, LLC v. NetScout Systems, Inc., but affirmed the district court’s $2.25 million post-suit damages award and ongoing royalty for future infringement award.

    The patent infringement dispute began in March 2016, when Packet Intelligence alleged that NetScout Systems infringed three patents related to a method for monitoring network packets exchanged over a computer network.
