CA Judge Dismisses Roku’s Motion for Source Code Protective Order in COVID-19 Patent Dispute

    On May 8, 2020, a judge in the U.S. District Court for the Northern District of California denied Roku Inc.’s Motion to Modify and/or Quash Canon Inc.’s Subpoena and to secure a protective order to prevent remote source code review during the COVID-19 pandemic.

    Roku, a non-party in the matter of Canon, Inc. v. TCL Electronica Holdings Ltd., et al., filed the motion on May 4 over concerns that producing the proprietary Roku operating system source code over a computer network for remote review brings “unjustifiable risk to its key business asset.”
