USPTO Releases Software Patent Examination Report

    On April 23, 2020, the U.S. Patent and Trademark Office (USPTO) published a report titled “Adjusting to Alice: USPTO patent examination outcomes after Alice Corp. v. CLS Bank International.”

    The report discusses the effects of the Alice decision on patent-ineligible subject matter rulings as well as how additional subject matter eligibility guidance issued by the USPTO has decreased the number of patent rejections. The report states that patent-ineligible subject matter rejections increased by 31% in the 18 months following the U.S. Supreme Court Alice decision.
