On July 8, 2020, the U.K.-U.S. Bilateral Data Access Agreement went into effect, marking it as the first agreement written into legislation to address 21st century concerns surrounding “data-gathering by domestic authorities where data is located overseas.”
The agreement allows law enforcement agencies within the U.K. to access data from U.S. communication service providers (CSPs) without review by U.S. authorities, and vice versa for the U.S. to U.K.
