On July 15, 2020, two attorneys at Mintz Levin published a blog that analyzes the effects of economic recessions on trade secret litigation patterns in the U.S.
The attorneys report that trade secret litigation significantly increases about three years after an economic recession, when the statute of limitations expires for trade secret claims in most jurisdictions. The attorneys also predict that trade secret misappropriation disputes will increase as a result of increased remote work arrangements during the COVID-19 pandemic.
