The Supreme Court ruled on June 22, 2018 that section 284 of the Patent Act allows plaintiff WesternGeco LLC to recover damages for lost foreign profits.
A jury had awarded WesternGeco $93.4 million in damages after finding that competitor ION Geophysical Corp. had manufactured in the U.S. but shipped, assembled, and sold internationally a product which infringed WesternGeco’s patents for a marine seismic survey system, which included a computer system for tracking the position of surveying components.
