ShoppersChoice Wins Shopping Notification System Patent Infringement Dispute

    On May 14, 2020, the U.S. Court of Appeals for the Federal Circuit (CAFC) upheld a decision in the U.S. District Court for the Southern District of Florida that granted defendant ShoppersChoice.com’s Motion for Judgment after finding a patent claim directed to an automated delivery notification system subject matter ineligible.

    CAFC affirmed the District Court’s dismissal of the patent infringement dispute brought by Electronic Communication Technologies (ECT) after applying the two-step Alice/Mayo framework, determining that the asserted claim was directed to “the abstract idea of providing advance notification of the pickup or delivery of a mobile thing.”
