Federal Circuit Rules U.S. Navy Breached Software License Agreement with German Software Company Bitmanagement

    On February 25, 2021, the U.S. Court of Appeals for the Federal Circuit overturned a September 2019 U.S. Claims Court decision in the matter of Bitmanagement Software GMBH v. U.S., in which the Federal Circuit found that the U.S. Navy had infringed upon the German software company’s copyrighted three-dimensional visualization software, “BS Contact Geo.”

    Bitmanagement filed suit against the Navy in 2016, after the defendants allegedly breached their software license agreement that had allowed the Navy to install the BS Contact Geo software onto one Naval computer system; however, the Navy allegedly installed the technology onto 558,466 computers.
