DisputeSoft was engaged as a consulting and testifying expert by the software developer Real Forms, LLC, in its suit against the Arkansas Realtors Association.
The ARA had attempted to end a software project implementation during beta testing, demanding return of payments to date and cancellation of a five-year ongoing operating and support term.
During beta testing, independent software testers identified errors in the Real Forms software which allowed agents to view the confidential client data of other agents. The ARA sent a notice of termination to Real Forms, citing security issues as the cause of the system’s failure to meet the ARA’s business needs. Real Forms argued that it had not been given time to cure the problem in accordance with its contract.
