DisputeSoft was engaged as a software expert in August 2018 by Bethesda Softworks LLC in the matter of Bethesda Softworks LLC v. Behaviour Interactive, Inc. et al. in the U.S. District Court for the District of Maryland, Greenbelt.

    In January 2014, Bethesda Softworks (Bethesda) contracted with Behaviour Interactive (Behaviour) to develop Fallout Shelter, a post-apocalyptic video game set in the Bethesda’s popular Fallout universe. As part of the agreement, all source code, designs, artwork, layouts, and other work product were owned by Bethesda. In October 2016, Warner Bros. contracted with Behaviour to develop a similar mobile application based on their science fiction television series, Westworld. Bethesda filed suit in June 2018, alleging that Behaviour utilized Bethesda’s copyrighted source code, design, and gameplay elements to decrease the cost and time needed to develop a highly similar mobile game.

    As a software expert, DisputeSoft:

    Restored Perforce source code repositories and extracted relevant source code and design documents.

    Filtered third-party and non-protectable portions of the Fallout Shelter source code from code developed by Behaviour in C# using the Unity engine.

    Analyzed the source code for evidence of literal copying using proprietary tools leveraged in our Code ACE™ service.

    In December 2018, the parties entered into a settlement agreement prior to DisputeSoft issuing an expert report.
