WASHINGTON, D.C. – DisputeSoft is pleased to share that T.J. Wolf, the firm’s General Counsel & Senior Expert, is the featured guest in the latest LFJ Conversation from Legal Funding Journal, published October 1, 2026.
In the interview, Mr. Wolf explains how software expert witnesses fit into funded litigation, including what separates a fundable software copyright, trade secret, or failed-implementation claim from one that only looks good on paper.
Highlights from the conversation:
- Bring experts in early. Early engagement helps preserve systems of record, sharpen requests for production, and spread analysis over a longer timeline, which often lowers total cost. As Mr. Wolf puts it, “facts known today that can be used are better than facts learned tomorrow.”
- AI-generated code adds evidentiary risk. When AI output is folded into a codebase, the development history can be thinner and harder to reconstruct. That makes questions of copying and provenance harder to prove or refute, and funders should factor that in before backing a claim.
Mr. Wolf also discusses why strict neutrality is central to an expert’s role and how an early technical read through pre-litigation services can shape strategy and settlement.
