Health Insurer Anthem Agrees to $48 Million in Additional Settlements for Data Breach

    On September 30, 2020, 42 state attorneys general reached a $39.5 million settlement with health insurance company Anthem, Inc., and California Attorney General Xavier Becerra signed an additional $8.7 million settlement with Anthem.

    The settlements resolve lawsuits concerning a 2014 data breach that occurred when hackers used phishing emails containing malware to gain access to a database containing the personal information of over 78 million individuals. The settlements follow a 2018 class action settlement agreement of $115 million, and an additional $16 million settlement with the U.S. Department of Health and Human Services’ (HSS) Office for Civil Rights (OCR) for alleged Health Insurance Portability and Accountability Act (HIPAA) and data privacy violations in connection with the same 2014 data breach.
